Please help (in NJ)!

Please help me if you can.

I live in New Jersey. I just received a call from my daughter's daycare saying their vaccine records were audited by the town's board of health, and they found that she is not up to date on her vaccines and if we don't get them by Jan. 5, she can't return to school.

We are doing a delayed schedule. She is ten months old right now. This is the schedule we've been following:

2 months - DTaP, Rotavirus

3 months - Pc, HIB

4 months - DTaP, Rotavirus

5 months - Pc, HIB

6 months - DTaP, Rotavirus

7 months - Pc, HIB

9 months - Polio, Hep B (this is where we're at right now)

12 months - Polio, Hep B

13 months - Pc, HIB

15 months - MMR

18 months - Chickenpox, DTaP

2 years - Polio, Hep B


They are saying she needs to have 2 more doses each of polio and hep b before she can come back to school. I know we are late on getting the 2nd dose, but I thought we had until she was 18 months to get the third (I realize the schedule above doesn't reflect that).

I asked what to do if she needs more than one dose, b/c she can't get two doses in the next 2 weeks, and the school said they would have to check and get back to me.

Does anyone know what the timeline is for getting these vaccinations under the law?

I'm already angry enough at NJ that I had to get her a stupid flu shot this year, and now this. Ugh!

It does seem that NJ requires 3 doses polio (but one AFTER the 4th birthday, so you should only need 1 more and not 2 more-- ask about this)

Also, all the New Jersey codes I am reading say that you do not need the 3 doses of Hep B until K.

I was reading the law about the hep b the same way. Thanks.

As to the polio virus, the law says:

(a) Every child less than seven years of age shall have received at least three doses of live, trivalent, oral poliovirus vaccine (OPV), or inactivated poliovirus vaccine (IPV) either separately or in combination, one dose of which shall have been given on or after the child’s fourth birthday or, alternatively, any appropriately spaced combination of four doses.

(b) Those children enrolled in child care centers who are too young to meet this requirement, shall be considered to be in compliance with this section if they are appropriately immunized for their age as recommended by the Advisory Committee on Immunization Practices (ACIP) of the United States Public Health Service.

(NJSA 8:57-4.11)

So, she needs three doses, one on or after her 4th birthday, like you said. Section b I find a little confusing, b/c if you look at the recommended immunization schedule put out by the ACIP, they recommend doses of polio at 2 months, 4 months, with the third dose between the ages of 6 and 18 months. So even if she does need a third dose before age 4, my reading is I have until she is 18 months to get it.

When I pick her up today, I'm going to ask for the name and number of a contact person at the health department to ask what law they are relying on to require these vaccines.

If anyone else has thoughts or knows something that I am missing, I would appreciate it.

There is no law governing vaccines. Vaccines are simply mandated for school or day care. That is why CPS can not intervene in any case simply based on not vaccinating. Nor can any doctor force you to vaccinate.

Again, you do not have to do that. If your mommy instincts tell you NO, then listen. This is YOUR child. Not some state-owned person like in the former USSR.

Vaccines manufacturers have all the power and money to buy off our politicians. But vaccines are not a law.

I can't really help but just wanted to reply how ridiculous it was that they are banning her from daycare for polio and hep B! There hasnt been any polio in this country for like 30 years now? And hep B is sexually transmitted! Really I mean, what are they afraid of? She is going to catch these (or spread them) to others? This totally baffles me and something needs to change in this country. This really makes me upset that some of these vaxes are even on the schedule at all. Those 2 in particular should be OFF the mandated schedule in every state! How totally ridiculous!!
