What struck me were the follwoing quotes

Quote:
The court held that the government was obligated to not only run public health programmes like Pulse Polio, but was also duty bound to protect people from the probable side-effects of the vaccine.
Quote:
“The constitutional obligation of the Government to improve public health is not confined to introducing programmes and administering medicines but extends to protecting a child under such a programme from all the consequential effects,” said Additional District Judge (ADJ) Kamini Lau.
Wow...I wish our govenment would take some responsibility....I know since the creation of the NVICP that will never happen.

ETA: Title meant to read forced Government to pay, not the court!!

I like that though they said nothing was wrong with the vaccine, he still noted that none were saved for testing later on. Go, judge!

I believe this is the main reason vaccines will never be made into law. As it is now, there is the reasoning that people choose vaccination and therefore much of the responsibility of that choice rests with the parents. If it were law, then the burden would shift. This would open a huge can of worms.

As it is right now, they maim and kill all the children they want, and it is a "no fault" situation. Of course a very small fraction of injured children get compensated, but the families have to go through heck to get it.
