FirstRight – Denny’s call to action

On Sunday, February 8, 2009, a mother visiting a Denny's restaurant in Asheville, NC was asked to cover herself or leave the restaurant while breastfeeding her child. When she quoted NC law and continued to breastfeed, the police were called and she was threatened with arrest.

Approximately one week later, the incident was reported to FirstRight, a national grassroots breastfeeding advocacy group committed to ensuring freedom from discrimination for breastfeeding children and their mothers. FirstRight has been taking action in accordance with the organization's established mission and protocol for resolving instances of breastfeeding discrimination.

While FirstRight is not sponsoring the protests that are reportedly being planned against Denny's in Asheville, NC and other locations nationally, the organization has been inspired by the circumstances surrounding this incident to attempt to contact Denny's national corporate headquarters regarding their breastfeeding policies. Although FirstRight has not yet received an official statement from Denny's corporate headquarters, the organization intends to engage them in a conversation that will result in the adoption of a breastfeeding friendly policy that will be mandated to all franchisee's of the Denny's brand.


At this time, FirstRight has been in contact with the Director of Operations for Success Management which operates 32 Denny's restaurants, including the Asheville, NC location. The current statement released by Denny's contains an unsatisfactory "discretion" clause for which FirstRight discussed possible alternative wording with the Denny's representative. Within the week FirstRight representatives intend to follow up on the progress Denny's has made in revising their stated policy.

Additionally, FirstRight encourages all breastfeeding advocates to make calls to their local Denny's restaurants and franchises to inquire about their breastfeeding policy and encourage them to adopt policies that are at minimum in accordance with applicable state laws. FirstRight also recommends making calls (1-800-733-6697 and also 864-597-8000) and emails (http://www.dennys.com/en/cms/Denny%2...ct+Us/195.html ) to the Denny's Headquarters to support them in adopting a brand-wide breastfeeding friendly policy that includes training of all employees. FirstRight asks those who contact Denny's to email a summary of their conversation to taskforce@firstright.org including the restaurant location and name and title of the employee with whom you spoke.

FirstRight expects that these actions will support Denny's in clarifying in the coming weeks their willingness to follow state laws and their desire to welcome breastfeeding mothers. If this is not the case, further actions may be considered by FirstRight at that time.

Denny's statement

The statement of policy given to FirstRight by Rick Pate, Director of Operations for Success Management which operates 32 Denny’s restaurants (including the Asheville, NC location) on 2/16/09 follows (permission was given to share this statement with others):

“We at Denny’s work very hard to insure all guests have a pleasant dining experience. Breastfeeding is absolutely allowed in our restaurants; we do request that it be done with respect and discretion, as we are a family restaurant. We defer to our managers to carry out the company’s position.”

During that conversation, I pointed out that "discretion" is a vague and subjective term, and one which raises red flags for breastfeeding advocates. By requesting that breastfeeding "be done with respect" Denny's implies that they think breastfeeding can be disrespectful. I also noted that I'm sure Denny's has policies in place requesting that *all* customers are respectful of other patrons, and need not single out breastfeeding mothers.

Very good points! I hope Denny's takes them to heart.

I can think of instances where my fellow restaurant patrons were far from respectful in their behavior, and none of them were breastfeeding.

Yes, exactly. The underlying message is that breastfeeding is an activity better suited to locations that aren't family-friendly. If you MUST do "that" in public, then take that baby and those nasty skanky breasts of yours to the nearest strip club, where you will both fit right in! [/snark]

How can the manager defer to the company's position when it is not clear what the position is or how to handle complaints?

Unfortunately this is one of the MAJOR problems companies have. THey do not have policis, or if they do the employees are unaware and not trained in them.

One of FirstRight's goals is to help companies to draft and implement acceptable breastfeeding policies.

I am just MINUTES south of where this happened and I'm so surprised! Asheville is a mecca of crunchy!

I can't say I've been in that Denny's, though I may have...but the one here in Hendersonville has never looked twice while I nurse my nearly 3 yr. old there.

So sad. And their "response" stinks.

I just watched the news clip of Crystal with her little boy -- she did a great job, although it seemed that the report was slanted toward her having done something wrong. Honestly, she is a pretty mama with an adorable kid -- maybe those leaving/complaining were jealous? The one lady in the clip who said she had to leave because it was SO awful (seeing a breast) said she was with her husband and son --- she certainly looked pretty stiff (maybe her DH was glancing over??!) . . . Anyway, I know my DH would not have had an issue ;-) Most breastfeeding husbands don't!

On a positive note, my 3.5 happened to see a baby being given a bottle on TV. He was visibly confused and asked, "why is that mommy giving her baby a bottle?" -- He honestly had no idea! "But mommy, mommies feed babies with breasts!" . . . Why, yes, yes they do! I am so happy to be raising a son that thinks BOTTLES ARE WEIRD, and BREASTS are NORMAL! :-) I love my kids.

I keep wondering why drinking milk from COW BREASTS is 'okay', but HUMAN breasts are NOT?! ?????? One would think the cow breast thing would generate MUCH more disgust!

I wish I lived closer -- Crystal is so brave!

Mamas let's keep this thread from being removed like the last one.

The call to action and need of acceptable policy from Denny's is irregardless of how the mama was physically breastfeeding. Denny's still needs an acceptable policy and needs to train its employees in how to handle people complaining about bfing mamas.

Please let's keep the other debates to different threads to allow this one to remain open and available as long as possible.
