As far as the contract goes, there could be something in the contract that they are violating, thus breaching the contract. If it mentions something about the parent handbook having rules of the school, etc. I would start by looking there. Is there anything in there about how the children will be treated? What about the brochures they gave you when you called or stopped in? Anything in there about the overall philosophy that they're clearly breaking?

After a terrible preschool experience that I tried to make work for two years, I got the guts to pull my dd out of the "cool preschool' that had a big waiting list full of hip mamas. It was the best decision I ever made. My only regret is that i waited so long and bowed to pressure from the adminstration, instead of listening to my own husband and daughter.

If in doubt, pull your child out. I would be really concerned about this person showing up in the classroom after you were assured that she would not be back. You are paying for a Montessori environment, not this nonsense.
