I think in TX the law says only between 36 and 42 weeks, so that is what my midwife does.
While I will have a homebirth any time after 36 weeks, I will be much more comfortable after 38. I just wish our midwives could go over 42 weeks though.
Have you ever tried the Brewer diet? The reason I ask is because my son was 10 days before my due date, my daughter was 35 weeks, I had a set of twins at 33 weeks, and then I did the Brewer diet and had another set of twins at 38+ weeks! I know it's totally not the point of your post, but I wanted to share.

That's amazing! I just had my baby a month ago..and was 2 days past my supposed due date..lol. I'd still love to see some information though
36 weeks, but cpms here have it as 37 weeks in their regs. lucky for me my midwife is a cnm who does hb's and by law is able to write her own protocols. 36 weeks is her min. cutoff.
I wouldn't be comfortable until 37 weeks personally. My MW is also bound by the 37 week rule here in FL. DS2 was born at 40w 1d weighing only 6 lbs 4 ozs so I'd be scared to see what a 36 weeker of mine would weight. It sounds like it is a liability issue for your MW and she can land herself in a world of trouble if the OB were to report her. I can see where she is coming from and I also see your side too.
