In a way..i agree with you. On the other hand the OP is the one who gets the crap end of the stick because someone had to be mean. I don't agree that there are few unfounded cases...I would be willing to bet it happens with much frequency.

I just don't think that someone should be able to report another person and then get off with anoniminity(?) because they lie or are being vindictive. If the OP has to be accountable to the state, so should the caller.... (meaning after the case in investigated and found to be unfounded the caller should be accountable to the accused).

Just wanted to post an update. I haven't heard from CPS or any drug testing agency that was supposed to randomly stop by.
I even called the guy that I have paperwork from when he visited me and left him a message yesterday because I haven't heard anything about this since the day he was here, and having anything involving CPS on my record could mean that I won't get into the nursing program that I am working so hard towards. (need child abuse clearances) If a false report on my affects my being able to achieve the goals I have set for myself and family, I just don't know what I will do.
People don't realize just how much this stuff affects the lives of those who are falsely reported.

I am so sorry mama. I couldn't read your story and not give you some support.

I think it's really terrible that someone else's ignorance is causing you and your family so much trauma. On a positive note, I am sure that it will resolve itself once the truth is known. I have not had CPS called on me, but I know a friend who went through it. She also has a LO who is on the lower percentile (in weight) and BFed well into her toddler years. Once CPS saw everything was absolutely f.i.n.e., they went on their way and there hasn't been any trouble since.

I also wanted to recommend using the breastfeeding growth charts to show that your LO is perfectly normal in terms of weight. Most BFed toddlers are super thin compared to those who had formula.

It shouldn't impact your nursing school goals - CPS reports are supposed to show up on background checks only when 'founded.' Being founded means the report was found to be true after investigation and a case was opened.

Can CPS even demand a drug test without a court order? I wouldn't submit to any kind of test or search w/o being compelled legally. What if there is a mistake w/ the test? I think that it's not unreasonable to be a little alarmist in this situation. Yes, most of the time it's probably going to turn out okay...but there's still a chance. I wouldn't waive ANY rights by allowing CPS anything that they haven't got a warrant or court order to obtain.

First and foremost.


CPS is not always the bad guy. But right now they have no legal right or standing to require you to do anything. They are asking you to do this voluntarily.

As for a lawyer you can try a few different places:
1) Legal Aid for your County/City
2) If you have a local law school try calling the law clinic as they offer assistance for free
3) If there is already a Court filing you can request the Court appoint you an attorney who is paid by a public fund. They are regular attornies in the community who willing work for the small amount that the Court pays out. It is generally paid out of the same fund as Public Defender's are.

Thanks for the advice. As it stands right now, I haven't heard anything else. I *think* it's not officially an open case. Just an accusation they are investigating to see if it's accurate. Of course, if the guy would return my phone calls, I would have a better idea.

Just wanted to post a kind of non update. I haven't heard from the CPS guy since he was at my house. Nobody has shown up to drug test me and I am really irritated.
The CPS guy hasn't returned my call from last Tuesday, and I think that is just rude. To accuse me of wrongdoing (or telling me someone else is accusing me) and then letting me twist in the wind for over a week and possibly longer is just evil.

When I had CPS called on me (I made a rant in my online journal while my whole family was sick about what a disaster the house was and someone called CPS over it, telling them all kinds of fabrications and exaggerations to make sure they'd come out), I had to call the guy quite a few times to get him to come back out. It was over two weeks.

Think of it this way: they can't be that concerned about you if they're taking their sweet time. If they really thought you were guilty of wrongdoing, they'd be on you like flies on poop. I am willing to bet they already have your test results and just put your case on the backburner.
