Bankruptcy and private school tuition

What I want to know is, how does bankruptcy (assuming we go that route) affect private school tuition? Can they make you take your child out of the tuition-based school? I know it wouldn't be written off or anything, just wondering how it would be impacted.

Are you including the tuition in the Bankruptcy? If so they could ask you to leave, if not they would never know unless the Business office has a reason to look at your credit report.

No, the tuition would be something new, not part of our current debt. I am not at all knowledgeable about bankruptcy and was/am worried that a judge would look at us paying money towards school but unable to cover our debts and be like, "um, get your kid in public school so you can pay", ykwim?

Technically, a judge can look at your proposed budget and reject it if s/he feels it isn't fair. so yes, they could say "take that money and use it for your creditors". But realistically, you will have everything settled with your lawyer before you go in for discharge.

I know that is pretty obvious advice, but I think they will be able to help. I know you can include homeschool costs as a budget item. I'm sure a private school would be a legitimate cost, also.
