I need help

My children have been in daycare for over 2 years now. Because of my daughter's Head Start after school program closed I am forced to make other arrangements. A Head Start/day care facility 2 blocks from where she currently attends accepted us as of yesterday and even had me call while in their office to transfer my child care grant to them beginning on Monday. I was up front from the moment I walked in the door about their vax status because I know the law and my rights and dare anyone to try to challenge me on it.

I just received a call about a half hour ago from the woman at the new center stating that they are not comfortable with my children not being vaccinated and did not want to accept them after all. I was pissed but I calmly told that PA law provides a religious/philosophical exemption and being a government funded facility that they were in violation of the law by refusing my children.

I'm sure I can win on this issue with no problems but now I don't even want them to go there. Sadly, I have no idea where else they can go that will be acceptable to me.

This is just ridiculous.

Where can I can get the info in black and white on the whole government funded facilities and that they must accept children with exemptions if the state has made those exemptions available. Even if they I choose in the end not to send them there I want to make sure they are well informed of the rights of parents and children.

Hi Sarah! Man, they messed with the wrong mama! I think you did great by informing them of their lack of rights in this situation. Good for you. If you know you're right, why not send the kids there anyway?

For Washington, I looked on the states website and searched vaccine exemptions. Then, I printed it off for myself and emailed it to the principal and the school nurse. i'll dig w/ you.

that led to pa 27.77, but i'm not seeing anything that says that they have to accept the exemptions. Maybe you can find it in the anti-discrimination laws?

That only applies to private programs. Head Start is government funded and therefore legally required to accept exemptions.

I would give the school a try. I am guessing that the woman you spoke with won't be the one working with your kids. You never know - you may end up loving the teachers!

So happy to hear you stood your ground. Good for you!
