Will my child support be cut in half when he has another child? (in CA)

My daughter is 4 and I've never received child support, but supposedly things are finally moving and they are supposed to start garnishing his wages. He makes over 100k a year so the payments will mean a significant increase in money. However, I also just found out that he's expecting another child. He is not with the mother so he will probably end up paying child support for that child too. Will my daughter's amount be cut in half? Or will he pay twice as much child support once he has two kids?

Usually it's something in between. Not sure the rule in CA, but I bet you can find it online. Where we are, a NCP with one kid would pay 20% and with two pays 25% for both. 30% for 3, and somehow it maxes at 50% (evenly split) for any number of children.

But I think CA is way more complex, with your income and his parenting time coming into play (they don't here).

Also, I presume he'll still owe you back pay at the rate for only one kid.

I would ask your lawyer. They will best be able to advise you.

That said, since your daughter and his new child have different mothers that *could* change things as well.

I do agree with pp that he could owe back pay, and would at the single child level.
