WIC Refuses Religious Exemption for Vacc.

Well, for 4 1/2 years, we have received WIC without any problem with vaccination records. They asked for a notarized statement of my religious basis for not vaccinating, and then asked that I get a statement from our pediatrician saying that he was aware that the children were not vaccinated. Those have been kept on file.

When I called to reschedule an appt., a new WIC worker told me he would not allow my chiildren to receive any further WIC coupons unless they were (1) fully vaccinated or (2) I gave him a letter from a rabbi or priest stating that our religious forbade vaccination. He told me the letters on file were meaningless because I had to bring in new documentation every time. (Yes, apparently our pediatrician may have forgotten that he was aware my children weren't vaccinated.) I told him that what he required was unconstitutional. He replied that was what he required.

I have printouts from the USDA website stating that WIC benefits are in no way tied to vaccinations -- they just try to encourage vaccinations. I also have a printout from the Ill. Dept. of Public Health in conjunction with the Ill State Board of Ed. stating that the supreme court permits personally held religious beliefs for a basis and a person cannot be required to belong (or not to belong to a particular sect) in order to be religiously exempt. It also instructs to ask for a statement from the parent about the basis of their religious exemption.

I'll bring those in. How do you suggest handling this? Our appt. is Wed.

You're on the right track for bringing in EVERYTHING that backs up your point of view. I'd also ask to speak to a supervisor instead of a lay person.

I agree with the PP that said you're on the right track. Just be firm without being a jerk and definately talk to the person in charge. I just went through this, not with WIC, but our school district and had to actually bring in printouts of the law. Once I showed the lady what the law was, she immediately apologized stating she had idea that was legal. Sometimes people are just ignorant.

Sure, I'd pack everything but pull out this first:

WIC Eligibility & Vax
"Immunization records and/or an infant/child’s immunization status are in no way tied to the receipt of WIC benefits. "

printed out from their own website.

Then I would pull out the state and regional office numbers (if they still fuss) and tell him that you would be happy to call them "right now" so he could tell them why he is violating WICs own rules.

Alphabetical Order by State agency name

FNS WIC Offices - Headquarters & Regional OfficesThe Food and Nutrition Service (FNS) is a Federal agency of the U.S. Department of Agriculture, responsible for administering the WIC Program at the national and regional levels.

HE is not allowed to "require" anything. WIC is a federal program administered by the states and the WIC clerks are not permitted to make up their own requirements.

It is easy to get heated, but just be casual about it...

In addition to everything the PP posted, if they try to pull anything like "Well, the requirements at this office are different", politely ask them to show you those requirements/policies in writing.

yes to everything already stated and i would add that you shouldnt give them anything else on paper since exemptions are for school entry only.

That is too bad I have never had a problem with WIC before.. Sometimes one of the workers will print off the kids Vax record and ask me about it but I just tell them that we don't vax.

One then asked me if I conscientiously objected and I said yes and there was no further discussion.

I agree with the PP I would bring the print out and just point out that you are not required to provide anything to them.

I would be sure to talk to this guy's supervisor. If he is saying this to you, he is probably scaring many other families as well. His supervisor should know that he is not following proper WIC guidelines.

From what I understand, although I could be wrong because this isn't from personal experience, I thought you didn't even need to provide what you did. If WIC is in no way tied to immunization status, I wouldn't think you'd need to turn anything in.

What he is trying to tell you goes against the WIC rules they can want whatever but they cannot require anything that isnt in the rules.

Oh, man. I can't wait to find out how this goes.

You should have never had to file ANY kind of exemption with them. No doctor's note, no letter, nothing. You definitely need to speak to a supervisor.

Emmeline is right. They tried to pull that crap with me once and I brought in the statement she posted and told them. They couldn't fight official stances. Bwahahaha.

Very interesting! It's very different from place to place- state to state. I've been to different WIC offices 20miles apart and it can be night and day on their Vax stance. I can't wait to see an update.
