baby vac. against signed informed consent

My daughter was given HBV vaccine on her birthday at the hospital. We signed an informed consent waiver before her birth. We discovered this on her discharge papers 10 days after she came home. We had attemped to have a home birth but after 70 hours of labor I had only dilated 6cm! So now Dr.'s are involved and tried to shame me about having a "failed" homebirth and fear monger me into things that are not state mandated. Can anyone help me know what I can do to get retribution from this hospital ( I live in TN if that matters)? Has this happened to any one of you out there? I fear the day that she experiences any side effects!

How terrible!

Sorry you are having to go through this!. I was afraid this had happened to us as well (my son is now 2 and I just got his records recently and there were decrepencies about the Hep B). Turns out that he didn;t get it, but it has happened all too frequently I'm afraid and I don't think there is much that can be done. If you have a copy of your form declining the shot and then proof that it was given, you can contact a lawyer to see if you have any legal recource, but I think unless your child was injured, there won't be much of a case.

Get a copy of her actual records. It's possible that she didn't actually receive it. Someone just checked a box that they check on hundreds of forms every week.

I am hoping that it was just a clerical mistake. Has anyone had an antibody screening before? I'm wondering if I should get one.

The FIRST thing you do is get her actual records. If it's in there, there's nothing you can do. The hospital will just say "oops, sorry" and that's all you'll get. You can't do anything unless you can prove harm directly attributed to the vaccine (which you can't except in very rare cases).

Was the card stamped, or was it signed and dated?
