Car title question

This is just a curiosity type question.

STBX asked me if I had the title to his car. His car that wont be paid off for 4 more years. I don't have it, as it was in his name, he refused to let me drive it once I left him. I have only ever owned one car before the one I currently have. I did not get the title to it until it was paid off. The current car I have I did not get a title for, but I've only had it a short time. He claims they send you a copy of the title and that I am keeping it from him. Is that true? If so, why didn't I get a title to my old car or current car? It doesn't really matter to me in the long run, because i don't have it, but I am just curious Sometimes I think he makes things up just to cause drama in my life.

It varies from state to state. For example, in MN where I lived for many years and have since returned, the DMV sends you the title with a lean notice on it, and the bank gives you a lean release when the car is paid off. In North Dakota, where I lived for a couple of years, the loan holder keeps the title. This seems to be the situation in your state, since you don't have the title's to your other cars.

I'm in IL. I only got the original title to my car (from Ford Credit) last year when I paid it off.

In my state, you get the title once you pay it off, if you need a copy you can request it from whomever your loan is through.

In CO, one gets the title when you pay off the car.

You usually get a 'clean' title when you pay off the car. You can usually get a title with a lien on it from the DMV or the lien holder prior to pay off. Sometimes you may need this for insurance, proof of ownership, or any other strange reason.

I've been following your threads for awhile and I don't remember if you have an atty yet. If not I would get one and direct STBX to have all communication to go through the atty. This is the same person who a few weeks ago couldnt be bothered to find the tax returns you asked for, but now wants a car title? I dont think so. You dont need the drama!

He also wants a copy of the marriage license, which I do have. Somehow I think it is going to take at least a month for me to open the fire safe that is currently under my left foot You know, because it takes time to do those things

Okay, thanks for the information! I am guessing my state must not send the title until the car is paid for, as that is what my parents also said. He probably just wants to stress me out. Didn't work

I wouldn't give him a copy of the marriage license either - not your responsibility. He can order one from the state if he wants one so badly.

tell him you'll give him a copy of the marriage cert when he gives you the tax info you need.

in ohio we get memorandom titles as long as the is a loan on it when it is paid off we get a proper title.

If he gives you a hard time about it, go to your state's DMV website and find the section about titles for vehicles that still have a loan on them. Then email him that link. Can't really argue with the official word from the DMV.

I think you should tell him that there is this cool thing called "the internet" that he could go to and look up how to get copies of marriage licenses and car titles. You could also tell him you only want to communicate via email, then you have documentation of hat he says (you might need it in court someday).

In the two states I've lived in as a driver, you don't get the title until you own it free and clear. Until then, all you have is your plates and insurance documentation in the glovebox. He's being a bleep.

He needs the marriage cert to file for divorce. If that's a direction you want to go in, and don't want to pay the filing fee yourself, there's little point to withholding it. I guess you could leverage the tax returns for it, but the bigger question is whether you want to get the clock ticking on the divorce by enabling him to file.

I didn't get a copy of the title to my car until I paid it off 2 months ago. It's been just over 5 years.

I have only owned cars in CA and AZ but the lienholders have always held the title(s) as long as they are the lienholder.

My Mother gave him a copy of the marriage certificate and she got the tax copies I need from him.

Now I have everything I need to file for divorce, except for the money. I am very distraught because I don't want to be married to him forever. He is so cruel to me I simply don't have the money. It breaks my heart. If I hadn't temporarily lost my sight, I wouldn't have all of these medical bills Oh well. At least I have my freedom, even if I have to wait to be able to be divorced.

I am scared he will call the police and accuse me of holding the title from him I really don't have it. I would never take that, I wouldn't have even known where it was if it did exist.

I think the police would laugh at him if he did this. If you are in a state where the lienholder holds the title, the police would be laughing at his stupidity for a long time. If you're in a state where the owner holds the title and a lien is printed on there (NY is like this), then all he has to do is order a new title from the DMV. The cost varies state to state, but in NY its $20 for a replacement title.
