has anyone dealt with a restraining order?

So after numerous events with my husband and drug use, I have finally had enough. On may 25th he came home high again, ruining his "last chance". I called the police and he was arrested with possession of prescription pills. I filed a restraining order the next day and it was served. Anyways all charges were dropped for him but he is still living away from us because of the restraining order. I'm filing for a divorce later this month but have questions about the order in place.

At the moment I don't mind him contacting me via phone to figure things out with the divorce, kids, etc. I also wouldn't mind for him to visit with the kids a couple times a month. I just need the order because I don't believe it would be safe for him to live with us anymore. Can I request this at our hearing on Monday? Or is it just going to be setting it as no contact, permanently or dropping it completely? I'm not sure how restraining orders work, can there be exceptions in an order (ie. Short visits on set days and phone calls ok) or is it all contact or none? Any input greatly appreciated!

As far as communication goes it typically will be ordered for there to be peaceful and reasonable contact during visitation exchanges etc. If he calls you out of that realm you can report it to the police. Temporary custody can be determined and typically supervised visits will be arranged. From what you are saying if you tell the judge you want your ex to call you and you want him to come see the kids then you may not get the actual restraining order. It shows you don't feel you need the protection. You currently have a temporary restraining order and the judge can take that away easily.
