Stbxh has not served me financial papers and our court case is coming up

We have a child support court date coming up in a week and stbxh hasn't filed or had me served his financial papers. I filed for child support and had him served a month ago. Does anyone know what happens if he doesn't respond? Does the court date then become invalid?

In NY you bring financial information to court with you, and don't have to give it to your ex before hand.

Where I live (Quebec), the opposing party has to serve your lawyer (and the courts) with a notice of appearance, stating that he will be present and whether or not he is represented. Failure to do so may indicate that the opposing party won't be appearing in court (though some have used this as a tactic to try to fool the courts and then make a surprise appearance).

Failure to appear in court means that the opposing party's lawyer can go for a ruling by default, which is what happened in my case.

Have you spoken to your lawyer about this?
