ah bureaucracy (a CS rant)

I went to court on May 3rd; I was granted sole custody of DD.

I went back to court on May 31st; despite the fact that they LOST my file and it cost me an extra 2.5 hrs of legal fees, I was granted an early divorce and child support.

It's been over 7 weeks and I haven't heard from the government office responsible for enforcing Child support orders. I called them and discovered that they have NO FILE in my name. No judgment was ever sent.

I called my lawyer. She's on vacation. So is her secretary.

I called the court house and discovered that in my file, there is no record of my judgment on custody or divorce. According to my file, I'm still married to XH and I don't have custody. So, somewhere along the way, *someone* didn't put my judgments in my file so it never got sent off to that government office.

I left a message with records management. They supposedly have 24 hrs to return my call. Then we'll see if they can FIND my judgment, properly file it and THEN send it off to the government who will THEN take another 4 to 6 weeks to begin measures to deduct CS from XH's salary. If they can't find it, I may have to take half a day off work and march myself down to the courthouse with *my* certified copy of the judgment so that THEY can start doing their job properly!!!!!

FUN huh?!

Do you have copies of the judgements? You should - they should have been given to you. If you do, send them to the court yourself.

Yep, looks like I'm going to have to pull my signed copies for them to start doing their job. It's a good thing I'm an organizational freak. Still, I'm p.o.'ed

I've got like 10 bad jokes about French Canadian bureaucrats floating around in my head right now, but I'm showing enormous restraint and controlling myself.
Ugh, but seriously, I would be so annoyed. I'm glad you have your certified copy. I wonder if you could give them the evil eye and get them to expedite the child support thing, since it was their error.

Barbie...guess I'm just "special"

Jen...feel free to let'em rip. I've got a few choice words floating around in my own head about French Canada bureaucrats right now (ok, all the time).

I'm going to see if the CS office will accept my copies of the judgment or if, because I'm super lucky once again, they'll need them to be sent from the courthouse, in which case I'll have to go down there and kick some people to get them moving in the right direction.

Ugh, that's awful!

If it's any consolation (not), I just found out that according to the county in which I divorced, my divorce is recorded as going through four months after I RE-married. What? You mean technically I was polygamous there for a while?

And yes, my copy of the paperwork says that I was officially divorced long before my remarriage.

Minor update that goes nowhere

I just spoke to the senior lawyer at my lawyer's firm:

I found out that it was my lawyer who had the certified copy of the divorce judgment, while I have the certified copy of the custody judgment. Now I have to call the CS office to find out if they'll accept receiving a certified copy of the divorce judgment from me or if they HAVE to have it sent by the courthouse in which case I'll have to drive out of the city to my lawyer's office, grab their certified copy of the divorce judgment and go CRAM IT DOWN the courthouse clerk's throat to make sure he doesn't lose it again and sends it off properly!

Of course there's a good chance that the CS office will not only require that it be the courthouse that sends them the divorce judgment but that it also be a copy of the ORIGINAL judgment they need, in which case I just have to sit on my butt and WAIT for them to rifle through the judge's chambers to find the darn thing!

Looks like the show's being cancelled Jen. The CS office just confirmed to me that *I* can't be the one to send the judgment to them--even though I HAVE ACCESS TO A CERTIFIED COPY, it HAS to be the courthouse that sends it.

AND to make things more fun, the courthouse won't accept the certified copy of the judgment from **ME**; they INSIST on findingTHEIR original copy of my judgment. They apparently have until 3:30 this afternoon to return my call and then perhaps we'll see if by giving them the name of the judge, along with the date of the ruling, it'll help them figure out where the document is.

Oh. My. God. Can I blow a gasket now? Please? I've been real good so far!

my sister is getting married in 3 weeks.... she did the whole cant pay thing, cant find her ex husband thing, etc, etc, etc.... then found out that the cancelled her divorce (for lack of a better way of putting it) because they lost her cant pay stuff and had it in her records as she didnt pay her fees.... now she has to do the whole thing over again

WHEEEEE!! Third time is a charm mamas. I called the Courthouse for the 3rd time, and the 3rd person I was transfered to HAD MY FILE *AND* my judgments in her hand. She said she's really backlogged on updating the files and she found mine at the very bottom of her 3rd pile. Heheh.

Because I was oh-so-sweet to her, she promised to do mine right away and to send off the documents to the CS office on Monday.

Now the ball is finally rolling on CS. In 4 to 6 weeks, I can bet that there will be sparks from XH's camp.
