I have a 4yr old dd who lives with me 100% of the time. I left her dad when she was 8months old.
There has never been a parenting plan between us. When I left him, he went back to his wife that was supposed to be his exwife. During that time, he saw dd at the mall or parks for an hour maybe? and never had her holidays. This continued till she was 2. At age 2, he started having her at his house one day a weekend, always a weekend day and then one evening during the week for dinner. He still never had her any holidays or overnights.
It wasn't till this year in Feb. that I was put in the hospital and I had my son premature. Because of the c/s and having to stay in the hospital, he had her for the very first time overnights. He had her like 4 days in a row, just at night. Later when my son was out of the hospital, I allowed him to have one night a week. So she would go with him at 6pm on Friday and stay till 12pm on Saturday, nothing big. I should mention I moved in Jan. and it's a bit farther away, so he gave up seeing her on the weekdays. He maybe had her a total of 8 nights(BIG MAYBE?) until he said he was dating this girl and she was moving in. I put a stop to overnights as he does not have a bed for my dd, she slept with him.
During this time my dd started acting out, she didn't want to go with her dad anymore. I mean, kicking and screaming and running away from him, clinging to me. She has even started biting people again and the last time she ever did that is when he was with his exwife. This has been going on since May, the kicking and screaming, refusing to go with him. She talks to him on the phone and repeats over and over "I don't want to see "her"" and I mean the whole phone convo. She asks repeatedly if she(new gf) will be there. I meet him and she refuses to go and it usually ends with her screaming and crying so hard, he just leaves. The past 2 weeks I have refused to meet him because of this.
He BARELY has been dating her and he moves her in and expects dd to be ok. Something has happened. He says nothing and blames me for mental abuse saying I put things in her head *rolls eyes*. He doesn't even care how she feels or what she wants.
So today I was served with court documents. He wants everyother weekend 5pm-5pm and everyother Wed night 5p-7pm. He wants odd year holidays and winter breaks/spring break and during the summer he wants wed-sun everyother week.
He lives in a small 2bd house. One room is his and gf's, one belongs to his 9yr son. He told me that he can make a bed for her on the livingroom floor in an earlier convo. He won't even talk to me, psycho gf has put a stop to that, so he will only email me.
Other than the 8 overnights, she has never been away from me that long. She also has medical issues, granted they are that big right now, but still. Plus she hates the gf!!!
I am in Vancouver WA and going to try and find a low income or a sliding scale attorney, but I don't know if I can. I have 1 week till we go to court. I have no idea where to start. I don't know what I should do.
