Custody/visitation issues and breastfeeding

I'm in the process of a divorce from my H. It is early days, but is moving very fast and I don't have an appointment with my attorney until Wed. I just want to have my ducks in a row before I go in.
Our youngest is 11 mos, will be 12mos on Sept 8. He still nurses several times/day and at least once if not twice overnight. He cosleeps part of the night with me and then moves to his own bed.
Is there any basis for asking for no overnight visitation right now because of this? I doubt STBX would get up and feed him in the middle of the night, and he would likely end up crying until he fell asleep out of exhaustion. That just breaks my heart thinking about.

Hugs to you, mama. I don't know about legal basis, but a friend of mine was denied overnights with his son until almost 3 because the son was still nursing. It may depend on your judge - I hope you get a breastfeeding friendly one!

From what I understand, it totally depends on your state and the judge. You might actually have better luck asking in the single mamas forum, as there are lots of ladies there who have been there, done that. Good luck.

yes, it depends on your state.

the ladies over in single parenting dont like to admit that bf babies are taken from their mothers for extended visitation starting at an early age. you can search my past posts for my BTDT. i was able to avoid separation, but only bc i followed a very knowlegable lawyers advice, to the letter. had i not accepted the fact that judges in my area ordered full 48 hr weekends at 6wks, no matter the feeding method, i would have lost my nursing relationship with my son.

besides my posts, you can search LLL for the writings of the late Liz Baldwin. she was the lawyer that i used for consult (we spoke in person). she saved bf for us.
