I'm trying to enroll my son into a private childcare facility. At first they told me that everything was okay in regards to his vaccination status. I can use a religious exemption and that I wasn't alone. Now they're telling me that the state is cracking down on private institutions and can no longer accept children without their vaccinations. I'm in the process of contacting certain people, but as of recently - is the state really doing this? I'm about to contact Albany to find out if it's really accurate.

Your thread said New York State, but I see your location says NYC. Unfortunatnly, those are like two different states all together. What applies in the rest of the state is a bit different then what applies in the city.

in upstate NY, from what I understand, even private day care centers who except any kind of state aid (rather for the facility, or for payment from patrons, ie government assts) they must follow the same guidelines as a public school district. If they are private, and except no government funds of any kind, they can except exemptions if they wish, but they dont have to. They can kind of set their own rules.

Im not an expert on this, but I do have two children in a private day care in NY state who are vax free. My facility accepts govnt funds, therefore, excepts my religious exemption without flack.

I'm sorry, I do live in NYC but I was told that the 'state' is cracking down on this.
And they do accept vouchers (government childcare assistance), which is why this shouldn't be a problem. I want to find out more information but the woman who said this to me is not answering her phone.

Okay so apparently it's an ammendment that was passed stating that private schools cannot accept children without vaccinations. But I can't find this anywhere...

I'm so confused.

If they accept government funding, how exactly are they a private school?

I have a lawyer that specializes in this specific area of human rights. I am going to contact him and see if he knows anything about this. If you like, PM me and I can give you his email address. I consulted him (for a fee) when I wrote my religious exemption letter. I contact him ever year to assure he is still in practise. I last contacted him a couple months ago, and he was definetly still around.

That is what I would suggest to you. Find a lawyer very knowledgable on the subject.

There is nothing in the law to prevent her accepting an exemption as a private entity, and as a facility receiving government funds she is not in a position to refuse an exemption. Below are links from the NYS department of health; the NYC area may be tougher on exemptions, but they cannot contradict state law.
