Hmmmm.... think this one will end up back in court?

DS was talking to his bio-dad on the phone last night. Quick recap- ex signed the passport papers for ds back in July because we thought dp's work was sending him to Australia this fall and ds and I were considering going with him.

So ex was talking to ds last night while ds was sitting on my lap so I heard this part of the conversation. DS said something about how he likes to travel and he goes to Florida. Ex said "yeah, I know. And you're going to Australia soon" (we haven't said anything to ds about Australia because we're not sure we're going. I think dp's work is sending him to China in December but ds and I aren't going to that one). DS responds with "Australia? No, I'm going to Japan. And Paris." All that came from ex's side was.... silence. LOL! Then ex said "well, that's interesting" Is ds going to Japan or Paris? NO! He saw it on a Phineas and Ferb episode and has been obsessing over it

After ds got off the phone with ex I called him to let him know how ds's eye dr appointment went yesterday (ex and all his family have a genetic eye disease that causes you to go blind by middle age. DS goes for yearly check-ups to look for signs of it in him. So far there's no signs at all!!!!). Anyway, so I called ex and told him. I figured he would ask about the Japan/Paris thing but he didn't say anything. I didn't want him thinking I was snooping in on his conversation (I obviously wasn't, ds just happened to want to sit on my lap at that time) so I didn't say anything to him about it. But I bet he's calling up his lawyer today claiming I'm running away with Owen

Yup, he's completely ignored all requests for answers from my lawyer. I talked to my lawyer a little bit ago and she said she hadn't heard anything from his lawyer so she was going to call him again and see what was going on. Again, no response from ex. My lawyer is basically saying that if there's no agreement then I don't even have to bring ds back to Michigan. If I do decide to bring ds back to Michigan (and I probably will because ds is really looking forward to seeing his Grandpa) then I absolutely do not have to let ex take ds (and shouldn't, in fact, because there is currently no agreement in writing which means he doesn't have to give ds back, because there's no agreement saying he does).

However, ex has apparently been filling ds's head with ideas that he's going to ex's house alone with him in October I am in the process of writing ex and email explaining to him that it's completely inappropriate to talk to ds about these issues when there is no agreement between us. I will also explain to him that he will NOT be getting ds alone in October. Sooo.... we'll see what happens.

Best of luck Steph I do think it seems like court but not so much because of the conversation but because O's dad is a piece of work...... and clearly he not even communicating with your attorney about logistic but filling O's head shows that he is a child in how he handles his priorities. Sadly I wish I were a fly on the wall when he tell the new wifey that he can't have O alone in Oct because HE didn't follow thru.... SMH!

I now have 2 email addys for ex (shocking since for the longest time I had NO way to contact him). One is *his* email addy that he just recently gave to me. The other is *their* email addy that Chickadee emails me from (signing ex's name along with hers). I've considered sending an email explaining to ex why he won't get ds alone in October to *their* email addy so that Chickadee can see exactly what happened

But I have a feeling there's already trouble in paradise with them so I don't really feel the need to spread more trouble their way. Ex can (and will) dig his own hole without me helping it along.

I would really like to be a fly on their wall after the new year when he gets a letter from the friend of the court informing him of the increase in child support (and it should be a hefty increase too)
