My Independence Party.... celebrating a new beginning!

To update those of you who have been following me on my journey...

Yesterday morning I was granted sole legal and physical custody of my daughter with no visitation granted to her father. And dd was granted the name change to my last name. Which is exactly what I requested!


I was granted 98% of what I asked for by default and the judge was extremely kind offering sound reasons for the two items I requested that she did not grant. So needless to say I was celebrating yesterday, and will be doing the same today.

So join me and have a glass or three of and do a little dance because this is my online independence party!!!!!!

I'm SO happy for you! I hope this New Chapter in your lives is taking a turn for the Awesome! I'm curious...what did you ask for that the judge did not grant? I'm glad that you got the three most important things though, Full Custody, No Visitation and Name Change! Congrats!

Thanks again everyone! I still have not quite come down from "Cloud 9" and I can't really believe the emotional drain is gone.... the court process was draining and I was on the ride for just over a year so I honestly am still in shock that there is actually an order in place. And that it's my dream order, given the way my ex has decided to be.

Great Question. The two items I was not granted had to do with future financial stuff related to any change in the order.

I requested if EX wanted to make a change in the order that we had to attend private mediation and the person seeking the change would have to pay for such, which the judge did not order because there is a mediator at the court for free and it's required to attend mediation first regardless. (I was really bummed about this because my ex is very manipulative and could easily woo over an overworked mediator if he wanted to) The other item was a long shot and I was not shocked I did not get it ---- I requested that if he ever decided to go back to court that he pay all attorney fees the judge said there is already a procedure in place regarding attorney's fees and that they look at both parties income and ability to pay and make decisions on that each time a new action is brought to court. I knew it was a long shot but hey I had to ask for it..... right?
