?? about Financial Disclosure form

Thread Starter
I'm waiting (and waiting and waiting) to hear from my lawyer about this, but thought I'd go ahead and ask here, too, in case anyone happens to know.

I'm in the initial stages of filing, and am filling out the financial disclosure that will be sent to STBX and/or his lawyer when he gets one. Granted, I'm probably overthinking this, but as far as expenses go, I can't decide whether I'm supposed to base them on *right now* (when I'm living with my parents, so have less expenses), base them on info. from six months ago when STBX and I were still living together (a bit more $$$), or estimate what my expenses will be within the next 6-8 months when DS and I (hopefully) have our own place and he starts daycare (lots more $$$).

TIA!

Right now. You will probably have to appear more than once for cs (I know my case is coming up again in December - nothing was finalized the 1st court date), and you can alert the judge to changes in your expenses when you move. Don't base it on before, b/c thats not whats happening right now - and right now is what the judge cares about.

But, keep in mind that any money your parents give you (as in, write you a check and you deposit it in your bank account) needs to be reported as income on the financial disclosure form.

I think you will have to do it for 'right now'. The point of it is to see what your financial situation is and what your needs are. For mine, I actually did it based on a move, but I was moving in less than a month. And so I already knew where I would be living, the rent, utilities costs, etc. I think with your move being 6 months away you would be doing too much guessing.

Although, that being said, if you are living with your parents because of circumstances around the separation (ex. you were a sahm with no income and aren't getting support and therefore HAD to move in with your parents) then I think that should definitely be brought up, right? You should definitely get your lawyer's thoughts on all this.

Good luck!
