Can I use a fabric as the background on a shop banner?

I still haven't set up my etsy shop because I don't know what to do about this.
I just hired someone to just make the banner for me. I am confused about using a photograph since the banner is so long and narrow. But he said to email him "some stuff," so I guess I need to think of something. I can't draw and I wonder if I can take a close shot of a fabric to use as the background behind my shop name.

Is that legal? Would it be a bad idea?

I feel lost sometimes, lol, and that's why my shop is still not up yet.
I guess I need to go and look at other ppls banners and see what they are using. Someone please tell me whether it would acceptable and/or stupid to try this idea of a patterned fabric as the background...please and thank you.

If the fabric is copyrighted (check the selvege) then I'd guess not. But he may be able to recreate the pattern of it graphically to fit your store style.
