So, I just spoke to my new attorney. He looked over my X's response and such, and because of the insurmountable amount of crap he has filed, it doesn't give much to go off of at all, and along with that, it doesn't give my attorney adequate time to prepare my case. He basically said that I should request a second continuance, to gain more time for the attorney to prepare. He is drafting a letter to present at court to do so.

First of all, if the continuance does not get granted, then I have to stick it out and make my case. Most likely, the worst case scenario will happen: My TRO isn't granted, but his is. (Then I'll be really screwed).

Secondly, if it is granted, then my attorney will be able to prepare, etc.

I am so unbelievably upset by all this... My birthday is tomorrow, and its really hard to celebrate and be happy when I have the above looming to take place on Wednesday (that is two days from today)! I hate my X. Seriously. He has caused me more problems in nearly two years than I have ever experienced in my life! I am unemployed, practically penniless (and my unemployment is on hold because of the dumb woman dealing with my claim), and I don't even have my own place.

I don't know your back story but first thing that came to mind was can you apply for a mutual restraining order? That's what I have with my sbx as we both applied for a n EPO but were not given it (him because police report said he was the agressor and me because I wasn't scared enough.) so when it went in front of our divorce judge she ordered the MRO.

Nope. He won't go for that. He's already lawyered up and paid alot of money to said lawyer. He basically will stop at nothing to make my life miserable.

Is your lawyer going with you to ask for the continuance?  Your lawyer should be there to ask for the continuance HIMSELF (or herself).  You should NOT go alone.

If your lawyer is unable to attend b/c of a conflict, he/she needs to write a letter to the judge explaining that you need an adjournment for your atty.

I asked him to via email and he hasn't responded.

I have no clue why he won't go, either. He did write a letter requesting the continuance but hasn't mentioned a conflict in the letter or to me.

Is this supposed to be a friggin joke??
