Actually, it depends on where you live.  There are several places, states maybe, that have made laws about dogs in cars.  Not sure what those laws are, but I know around here there is one and you can be cited and your dog removed.

 The code the cited us on is under animal endangerment I believe. In Arizona there is a state code and this particular town had a municipal code. However, the way the it is worded it seems that the actions are likely to result in injury or death. So, the police in this town threw common sense away and told us our dog was in distress because he was in a vehicle that had the potential of becoming too hot.

Thank you for mentioning it.  We moved to Arizona a couple months ago and I had no idea they had a rule like that.  Good to know.

So sorry for you and your dog.  Those rules are there to help protect animals and when they are abused like this it is really sad.  Good luck in Court.

So sorry you (and your pup) had to go through this, OP.    37 degrees and they were worried about your dog getting too hot?   Have you ever sat in a car at that temp? No way you could get too hot unless you were strategically placed so that the sun were shining right on your head and you had no way to move.  Even then.... I just don't see it happening.    

 

One of the many reasons that I love winter is that I can take my dog more places.  I am extra, extra careful about taking him anywhere if it is over 60 degrees (F) out so summer trips are hard.  But, in the winter, he sometimes comes with me for a grocery run just cause he loves car rides.   He has a blast looking out the window on the way there, naps while I'm in the grocery, and has a blast on the drive home.       I can't imagine how I'd feel if I came back and someone had removed him from the car for his own "safety".   I hope the charges against you are dropped!

Thanks for the good wishes. Hubby has court date at the end of this week, but I imagine they will just reschedule a date once he pleads not guilty. Total pain since the town is about an hour away. We did find out the max fine is $300.

 Thanks! Dh made his appearance to plead not guilty. The judge hinted that if he pleaded guilty, then it would be about $150. Now, if they find him guilty they could fine him up to $500. His court appearance is a week from today. Ds has off school that day, so I think we will all go. After all, I am a witness.

Wow!  Thank you for bringing this issue to my attention.  My dog has horrible separation anxiety when left home but does fine when kenneled in the car.  I would never leave her if the weather was warm, but I do tend to take her on all my errands and will leave her in the car while I run into the market or grab a bite to eat.  I didn't even know this was against any law.  I mean,  I assumed someone might call if I were to leave her in the car in the summer. . .but I don't see the risk in the winter (as long as it isn't too cold).  I really hope everything goes well in court.  Any way your vet could be a witness, knowing you and your family?

I'm in AZ and take my dog with me all the time! Of course, I only do it in cool weather but, I never, ever even considered it would be an issue with police! That's crazy!

Dh met with the prosecutor. Dismissed!!

The pile of evidence dh walked in there with was rather amusing. Letter from our vet, photos documenting where we were that day, a print out of the weather for that day, etc.

 

Then they bonded over the photos of the Gabby Giffords memorial.
