Where I live, it wouldn't happen.  The court won't allow TPR in the absence of horrific abuse unless the custodial parent's spouse is willing to adopt. 

Are you saying the father and mother broke up and one of them has a brother that wants to adopt the child?  If it's not the brother of the mother, is she with her ex's brother in a committed relationship?

I think that dad SHOULD. be able to do that. But I agree with the pp most courts won't allow it . Is it something the day wants I might ask a lawer or family law clinic if in your area . If that days wants to retai his rights your in for a long fight

the father is willing to sign his rights, he does not plan to stay in the state after his time is up in the guard.

they are willing to adopt the child, still waiting to hear from attorney. father is guard and was deployed for year and plans to move back to his home town when his time is up and wont be around for the child.

Not without consent of both the parent giving up custody and the parent retaining custody.  Don't forget that with adoption comes child support.
