Quick ? about visitation schedule

Do you consider this past weekend (with May 1st falling on a Sunday) to be the "first weekend in May," or will next weekend (May 7-8) be the first weekend?

XH is arguing the schedule.

I consider that next weekend is Mother's Day (in the US) and that's all that matters for weekend scheduling.

Yep, Mother's Day weekend is definitely my weekend.  :-)  XH is just arguing that the next weekend after that is the 3rd weekend instead of the 2nd (he normally has visitation on the 1st, 3rd, and 5th weekends), which is not correct, IMO.

At least he wants to see DS...I am glad about that part!

I have my kids on the 1st, 3rd and 5th weekends and I had them this past weekend and will also have them next weekend. The 14th is the second weekend.

If your ex had them this past weekend as a 5th weekend, then next weekend would be considered the 1st.

Thanks.  That was my understanding, as well.  I think ex is just upset because he forgot about Mother's Day (our agreement states I have DS for mother's day weekend, and ex has DS father's day weekend, regardless of regular visitation schedule) falling on "his" weekend, and he wants to argue.

It should be spelled out in your decree which day of the week determines if a weekend is 1st, 2nd, etc. My decree states it is Friday that determines which weekend it is, so the FIRST Friday is the FIRST weekend, and so forth. Mother's Day and Father's Day go to that respective parent regardless of which weekend it falls on.

Some decrees state that weekends are determined by Saturday, but IME, they go by Friday. I'd go back and read your decree for the specific wording. If there is none, I'd google typical custody arrangements for your particular state. In Texas, it goes by Friday as a standard rule.
