Would any of you seek legal advice for this?

I do a delayed vaccine schedule with my 13-month-old son, as I do with my 3-year-old daughter. My son has only been to the doctor 3 times since birth, but with 3 different doctors because we have moved 3 times since he was born. A few weeks ago I took him to the doctor (the third time), and unfortunately did not have the immunization record for the 2nd time he was seen (at a different office). Anyway, I just got that record over the weekend and upon inspection, found out some disturbing news. At that visit, which was back in October, I had a long talk with the doctor about how I wanted to vaccinate my son on a delayed schedule and did not want him to have more than 2 vaccines every 3-4 months. She ultimately agreed and we decided, together, what he was going to get that day... just Dtap and PCV (pneumococcal). Well, they gave him the pneumococcal like we talked about, but instead of just Dtap, they gave him Pediarix, which is a combo vaccine that has Dtap, Hep B and inactivated polio. So, in essence, he received 4 vaccines instead of 2. We never talked about doing a combo shot. There was no discussion, EVER, about doing a combo. Had I known, believe me, it wouldn't have happened. I feel I was completely deceived and am really angry about it. The thing that makes me angry the most is that I can't go back and change it, obviously. So, I just don't know what I should do. Several months have gone by. What recourse do I have? I never thought to stop the nurse who gave him the shots to question what they were because there were only 2 so I just assumed it was just the Dtap and PCV. I have written a nasty letter to the doctor, and am waiting to send it, as I try and figure out what I should do about this. I can't imagine the nurse who gave my son the shots screwed up because she goes by what the doctor tells her to do. So, I was deceived, right? My son has not suffered any ill effects up to this point. You think you do enough to make it clear to these people what your wishes are and then, BAM, something like this happens that is out of your hands. Going forward I will always question the doctor and nurse at the new practice no matter how many times we talk about it. Y'all should do the same. Don't trust anyone, ever. I usually don't, but this one time that I didn't cross every single t something happens. What do I do now?

You could file a complaint with your state's licensing board, stating that your child was given vaccinations without your consent. I'm sorry this happened to you.

If you could find an ethical, like-minded lawyer (tall order, I know wink1.gif) who would give you a free consult, it wouldn't hurt!  I'm really sorry!  I'm soooo worried about this happening to us.

Me and the hubby haven't talked about it again. I feel that I should send the letter that I wrote the day I found out about all this. I feel that this might be a "my word against yours" scenario although it was indicated in the record that I only wanted to give my son two shots at a time. Wish I knew they consider the combo vaccines as one. Seriously, we never talked about doing combo shots. Grrrr, it is making mad all over again. Perhaps I should write nasty reviews about the practice where you can do that. Maybe that will make me feel better since there is nothing I can do about this, as it has been months since he got the shots.

Did they have you sign for consent?
