Requesting your file from therapist

Can anyone tell me the legal issues around this? I am in CA and would like to get my file(s) from a therapist I worked with for a year. I wanted to know what to expect. Is this something where you ask only for copies? Thanks.

Your medical records legally belong to you, not the doctor/doctor's office/hospital. You should be able to request and obtain them with no issue.

 

You will generally only be provided with copies and not the originals though, since they do need to keep records for their patients.

Most medical offices will not allow you to take the file, but you are able to access, copy, etc. Typically there may be some turn around time. There are also some circumstances where the provider can legally withhold if they feel it would cause serious harm to see the record. I have only heard of this happening in hypothetical situations, but that may require some legal aid. Usually you would just call or sign a form.

can they refuse letting you have copy of your records if you have a balance due with them?
