IEP questions, curious about 2e and Physical education

My daughter is nine years old. Her school is wonderful, but I have to make sure that things are being done. I am a SAHM, so I do make sure things are being done by popping in, doing volunteer work, and so forth. Plus, my daughter is verbal, so she tells me a lot. She is 2e, gifted and Asperger's and speech impariment. I am attemping to get her qualified for other health impairment, and the school should be embarrassed about the resistance that has gone on with just giving me the form, but that's another story. Here are the questions: 1) Our daughter hopefully will be qualified as other health impairment for medical problems, including being VERY physically clumsy. She is nine, but her private OT and PT found that she was in the bottom 1st percentile on a lot of areas, and in almost every category she is below that of a four year old child. In spite of this, she is ambulatory, so the school says no PT, not even as a consult, and no adaptive PE. Ok, I understand this, but plan to challenge it later. She may be lower than a four year old child, but that's as low as this test reports. But my big issue is regarding the fact that they are refusing to use PE goals, saying that the PE goals are just the regular curriculum. They will not do a PE assessment, and they will not help her with interim goals. They said they "can't" because PE is not "academic." They admit that she is below grade level, but say their accommodation is that they will not grade her and provide her with a one on one aide. But no goals. She is at least years below age level by my PT and OT reports, but of course, by grade level, at least three years below since school would not have started until she was five. I would like your opinions on that. 2) My daughter is also 2e, but they do not want her to have academic goals, because she is ahead of grade level. This part just confuses me. I want her to be marching forward, but they said that they will only provide academic goals if a child is two or more years below grade level. They say no goals are necessary, even though she is more than five standard deviations between her highest and lowest scores on her IQ tests (10th percentile v. 99 percentile, with a SD of 15, I'd say that's a LD if I ever saw one). 3) I am sure by now you see the logical inconsistency. Ok, no acadmic goals because she is not two years behind. But PE, which is part of the general education curriculum, for which she is at least FIVE years behind age wise, perhaps more, they claim that she does not need goals, since they won't grade her for not doing well. This makes no sense to me. I feel that they just don't want to make PE goals. Once they have PE goals, of course, I will expect them to do what they need to do to ramp her up towards meeting those goals and they will have to set up services and supports for her to meet those goals. Please give me your thoughts on this. Thank you.

Just a quick thought...given how often aspergers is diagnosed along with non-verbal learning disability (statistically, I think, half of all children with aspergers also have NVLD) it would benefit your daughter to have a specialist determine if her testing scores give her this diagnosis.  (it is a diagnosis determined mostly by very large discrepancies in verbal and non verbal scores) The red flags that you mention for me are her physical clumsiness, her verbal acuity and the very large range in her scoring which is the hallmark of NVLD.  If she has NVLD then a specialist can make recommendations to support her based on this learning disability because it is in fact a learning disability that has global effects.  Supports are important in math, gym and sometimes with executive functioning issues.
