I tryed to get some BF pics done at JCPenney but the manager said it was aginst their policy, is that legal?

It could be, espessially if they have one written out. Did you ask to see their policy. I know many private photographers who happily do bf pictures, but I never thought about having any done in a department store. Probably, bc all we have is Walmart here and their pix always turn out crappy.

I don't imagine it's Illegal. But I wouldn't have expected them to take BF pics since they don't take nude pics of babies. IME.

Have you tried Sears? They wanted to take a nakey pic of Bran (a tasteful cute one) but we wanted pics in his fluffy diapers instead...maybe they'd do a bfing pic?

I cannot figure out JC Penney's policy on nudity/etc...

I have been told the following:
naked til 1 year
diaper only til one year
no nipples over six months
no nipples (on girls) over one year

I think it might just depend on the photographer, as well.

How will they know your baby is a girl?

Would they take a picture of an adult woman without a baby wearing a cleavage-exposing dress? If so, they should be able to take a discreet bf pic that just shows the back of the baby's head and the top of the breast.

I agree, ask to see the policy. Often these "policies" are nonexistent.

On the other hand, do you really want to have this special portrait taken by someone who is uncomfortable or even hostile to the idea, regardless of their official policy? I would rather find someone who is willing and tasteful, with a good, artistic eye.

I have a lovely naked picture of dd, aged 7 months. (Picture People).

TiredX2 - those rules are very disturbing IMO.

As to the OP question - now if your state has a law that says "anywhere a women is allowed to be" and you are allowed to be in the picture, doesn't that imply that they have to let you be breastfeeding?

Ah, but they can still refuse to take the picture! They just can't stop you from nursing. Interesting loophole there.

yeah... this is what I'm thinking. Texas does have a law protecting bf. But they also have a "right to refuse service" law. So I dunno.

I agree with Victorian, I took a partial nude picture of my son at the Picture People. They have a store in the mall in my home town in CA. I had a picture of my son nude in a wash basin (family tradition), he was naked but he couldn't see his little penis because the wash basin and his legs where in the way. They never even mentioned not being able to take the picture, though his genitals weren't exposed so that might make a difference. BUT they did put me in the window to take his picture, luckily I was able to hide his naked self for the most part from all those strangers.
