is there a law for what age your child can go in a booster?i am talking about the ones with built in backs but us the seat belt.my daughter is so uncomfortable in her seat,she needs more room.she will be three next month,

I'm not sure if there is a law for the age, but there is for the weight - 40 lbs. (most carseat straps (the 5-point harness thing) are not made for children over 40 lbs)

My 3 year old has been using one for about 6 months now. (she is well over 40 lbs).

A: These laws vary from state to state. Some use upper age limits—from 5 to 8 years old. Others weight limits—from 30 to 80 pounds. Some even use height limits—up to 4'9" tall. Some laws use a combination of these factors.

At its most simple, though, a booster seat should be used once your child has outgrown the upper weight limits of the forward-facing seat (which often happens around 40 pounds). He should use the booster seat until a seat belt fits him properly, which means that he can sit with his back against the back of the seat with his legs bending comfortably over the edge of the seat. The lap belt should fit snugly against his upper thighs or lower pelvis, while the shoulder belt comes across his collar bone (not across his shoulder or neck).

I don't know the law, but a harness is MUCH safer than a booster with just a seatbelt. I intentionally bought a carseat that goes up to 65lbs so that my dd will be harnessed in a seat as long as possible. (actually after she outgrows this I really expect to put her in a Husky or similar seat so that she will be harnessed in the booster too.
