I would recommend an mp3 player. I am partial to iPods, personally. Just to clarify- user to user music sharing is legal. She can upload any of her friends CDS onto your computer and convert them into iTunes files, upload them to her iPod and delete them from the computer. (Just so long as she turns off automatic update!) User to user music sharing also includes user to user sharing online. Napster was illegal because you are downloading from random people. There are clients that are user to user, like soulseek, that are safe.
With the disc player she can only play the CDs if she has them with her. With an mp3 player she can take all her CDs with her, in a sense, and all her friends' CDs as well. No contest, IMO.
Also, almost all mp3 players have rechargable batteries. If you were to decide to get her a discman, I'd recommend one that also reads mp3s. That way, any music file she legally downloads or gets from a friend can be played in mp3 format, which means carring one CD with 60 songs as opposed to 16.
