I live in Nebraska and homebirth is indeed illegal. Last year HB mamas went to the legislature again to try to change the law..it did not pass. Not to say women are NOT having HB...but they are either UCing or having MW' come from out of state. THE LAW NEEDS TO BE CHANGED!

Hi Mary, welcome to MDC!

I believe it is homebirth with a midwife, or more technically practicing midwifery at a homebirth, which is illegal, not an unassisted homebirth. Seems like this has come up before... does anybody have a link to the law that deals with this?

unassisted childbirth is legal everywhere. in the state of nebraska, it is illegal for a CNM to attend a homebirth. it is also illegal for the father to catch the baby (he can be charged with practicing medicine without a license).
