I WISH WISH WISH WISH I could have a homebirth, this anxiety is so bad!!!
That is plain bull crap. It is the law here in MI too, but law or now law, you are the parent and you make the choice. That lady just doesn't know what she is talking about. She repeats what she has learned and that is all. I can't stand them trying to scare you like that, they did this to my sister-in-law in Chicago. Turned out they didn't have a leg to stand on. They just kept scaring her. It worked too for the most part. If they smell fear they will come after you. That is why you have to know your stuff and Stand up for what you know.

The courts have ruled the U.S. Constitution "protects the (fundamental) right (of parents) to make decisions concerning the care...of their children." In fact, a 1979 ruling specifically says that just because a parental decision "involves risk, does not automatically transfer" the power to decide to the state.

Earlier this century, the United States Supreme Court declared "The child is not the mere creature of the state; those who nurture him and direct his destiny have the right and high duty to recognize and prepare him for additional obligations." Sad thing is that lower courts (STaTE) don't always recognize the higer courts opinions.

Truth is you have to fight sometimes. Our States want to assume they know best, when all they really care about is more money in their pockets.

Good Luck!

Here are some Lawyers who fight for these kind of issues. http://members.aol.com/wpowellcom/home.html
http://www.sarasotalaw.com/
http://www.abanet.org/legalservices/lris/directory/

You can also call your state lawyer or the department of justice and tell them about what you are dealing with. How they are infringing on your rights.

Not that anyone wants to go as far as this, but scare them for a change, instead of being scared. Throw in that you want to talk to the person that handles grievances at the hospital. You could also throw in the phrase 'Intentional Infliction of Emotional Distress. That will really get them running.

Also check out these legal sites for more info or email them for help. http://civilrights.org/
http://www.justiceforfamilies.com/
http://www.inc.com/welcome.html
http://www.healthlawyers.org/

Basicly go in with all the amo you can get your hands on.
