Immigration laws.

Ok, I need some help!
I am appling for a Green Card as a foreign citizen married to US citizen. In order for me to get it I have to pass a medical exam- which includes vaccinations. I have to show them my medical records ( which are translated in English and certified), but my records are missing MMR shot ( they did not do them in my country when I was little) so they tell me I HAVE TO GET IT and there is no way to skip it! And I am right now ( plus absolutely against vaccines!!!!!!! ) In a book I am reading right now ( the Guide to Vax) it says I should hire a lawyer who will put a case for me, etc. Well, I do not have to tell you- it is expensive to apply in a first place, and I do not have $$$ for lawer either. Is there some kind of simple form I sign, the same I would for school for example, saying that I do not vax????
Thank you

Who said that you MUST vaccinate? Request it in writing. Vaccines are NOT a law in the US and therefore they can NOT force you to vaccinate under any circumstances.

You are already living here, right? Ohio. They have religious exemptions.

Yes, you must vaccinate unless you fill out a religious exemption.

First step is to demand it in writing from whoever told you so.

OK, I will do so, cause I think it is in writing.

There are requirements, but there are religious and personal conviction waivers to the immunization requirements as it relates to immigration. You would need to use this form (see the bottom): http://www.usvisainfo.com/object/forms/state/ds3025.pdf

The exception are under INA Section 212(g)(2) - I'll get you a link

Just to confirm - you're in this country already, right?

Okay, then you wouldn't be using the form I linked because that's for people coming in. Do you have this form - this is for people who are already here: http://www.uscis.gov/files/form/I-693.pdf

It states at the end:

"Immunizations are not required, but the applicant should be encouraged to goto a physician or local health department for appropriate immunizations."

In the link I found it says
If your waiver application is based on religious or moral
objections to vaccinations, you must establish that:
You object to vaccinations in any form; and

You object because of your religious beliefs or
moral convictions (you do not need to be a member
of a "mainstream" or recognized religion);
Your beliefs are sincere.
At a minimum, you must submit a personal statement
describing the basis of your objection.

Could anyone help me find an example for : personal statement, object to vaccinate and object cause of my moral convictions? Just an example I could use to create my own?
Thank you!

yes, I saw that at the end:
"Immunizations are not required, but the applicant should be encouraged to goto a physician or local health department for appropriate immunizations."
But it also said- Clearance - immidiate, so i think I still have to have a waiver

$95 well spent.

If you didn't have vax there is a good chance you have natural immunity. Do you remember having MM or R? I had the measles vax as a kid, but not mumps or rubella, nor did I have any clinical signs of disease, yet the civil surgeon who did my med. exam for my gc app. checked my titres and I am immune to all 3. I did not have to get vaxed.

I would go to your med. exam first before going ahead with the waiver. The doc is not there to force you to do something you don't want to do. My guy just encouraged me to get the shot but was happy to do titres when I said no way. He is actually being paid by you to help satisfy the requirements of the gc application. He may be willing to work with you to help you get there. Even if you tell him you are pretty sure you had the diseases, that might be enough (it was for CP - I told him I had it as a kid; I also told him I had a tetanus vax within the last 10 years, he just wrote it down, no proof required.)

Good luck. Keep us posted.

Tracy

Edited to add: I went to my med. exam without doing the waiver first on the advice of our extremely high-priced, sought-after immigration lawyer!

I see your point, but why get a blood draw when you can just submit the form?

Good question! Actually, when I had investigated the waiver, I was under the impression it was more expensive than $95....it was in the neighborhood of $250-$300. A blood draw was $65. That was part of it, the other part was I really wanted to keep our application as simple as possible - my dh and I are both Canadian so there was a possibility they could just turn down our application if they thought we were "troublemakers" or "noncompliant" or whatever. Just wanted to keep it straightforward, no red flags, y'know? We waited for almost 6 years for our green card, didn't want to hold it up anymore!
