Bankruptcy?

DH and I need to file Chapter 7 but we can't afford an attorney. Hell, we probably can't even afford the filing fee. I tried to get the Legal Aid office to handle it but they won't because I'm not being sued for medical bills (WTF?). Basically, I'm screwed and it looks like I'm going to have to file Pro Se. Yay!

Right now we're judgement proof but if DH gets a better job or I get a job we won't be. I'm not getting a job just to have most of my income garnished. Flame away if you want, but I'm not leaving the baby and potentially damaging our breastfeeding relationship to bring home peanuts. Our van was repo'd in early January so I know the financing company is probably going to sue before long. They won't get anything but it's still a hassle.

Has anyone filed pro se? I've gone over all of the forms and it looks somewhat confusing but overall not too difficult. It probably helps that I'm studying Criminal Justice and will hopefully one day attend law school, so I've had classes regarding various laws and court procedures. We'd like to re-affirm our mobile home (not paid off) but if we can't it's no big loss. It's a POS anyway and the only reason we want to keep it is because it's cheap. We pay $267/month for 3 bedrooms and renting would be a lot more than that.

Any advice would be greatly appreciated.

There are some very helpful people on CreditBoards. They can help you out. Plus, there is a book to buy that is supposed to be a wonderful resource, especially for Pro Se.

An aunt of mine used nolo.com and got stuff to file pro se.

Thanks. I actually started out with creditboards and that's how I ended up trying to get Legal Aid to help me. They don't seem to have a lot of info about filing pro se.

Do a web search for Bankruptcy Forum. It's an EXCELLENT resource, but I will warn you - under the new law (which became effective in 2005) they don't recommend going pro se. Is your case totally no asset? In that, you don't have a house or anything the bankruptcy trustee could take to pay your debts? If it's an asset case, you must get an attorney (we're doing a Chapter 7 asset case at the end of this year).
