info on CS/custody in Utah vs. California

Hi,
I have the choice to move now before a possible divorce (with DH's consent). Anyone have info/experience with the deciding to go with a divorce in UT vs. one in CA?

I haven't seen a lawyer yet (see my other post asking for referrals). Does which state handles it depend upon where papers get filed first (my DH will be in CA and I will be in UT)?

I don't know any particulars about filing for divorce. I believe that there will be a waiting period before you could file in UT, though.

As a mama who desperately wants to move but has so far been thwarted by my ex, I want to tell you to move now while DH is accomodating. All too frequently divorces that start out friendly go really bad really fast, and agreements entered in good faith go straight out the window. If you can establish his consent to the move now it will go a long way toward retaining that right if the stuff hits the fan.

For child support reasons, I would file in Ca. They are much stronger child advocates than most states.

I'd do a lot of research about support laws in Utah before making your decision. CA is very good in support of spousal and child support (especially for "displaced" homemakers) and I don't know if Utah could beat what you could get here.

FYI: I am finding the C/S calculations to be decently high. (enough to live on If I'm really careful, and suppliment income with bookkeeping work at home)
However spousal support comes with the requirement that I be working outside the home...Not an option for me. I will live on a tiny income and homeschool my unvaxed kids. Period.
Also do you have any feel for how involved your H/futureX wants to be in your child's life? I am really comming up against that just now. My stbx wants 45% physical custody and joint legal and his atty thinks he will get it:
I am finding a good support network to be essential! If you have better support in Utah then I woould say that should be a serious consideration even if the C/S calculations are lower (They probably will be because, at least in CA they are based on the cost of living minus what you could make working fulltime at a min wage job)
