I'm convinced the attorney not showing is strategic. See with it only being a pretrial , usually evidence isn't submitted and they dont like to hear a lot out of the parties. but these motions have been filed in advance and the GAL wrote an additional letter to the judge to try to get this straightened out. Also the GAL is going on vacation friday so his lawyer probably thinks she can get this put off for weeks.. or try to have it when the GAL isn't available. My lawyer said the judge can still proceed,so I'm praying that he will. We are also wondering if my ex will even bother to show up without his representation. I meet the lawyer today to go over some last minute things. I'll let you know what I find out... and then of course, tomorrow is the big day.

I don't know if I missed this but the GAL is extremely upset and is leaning more towards no visitation for awhile

Wow, his lawyer is really sounding like she is resorting to really slimey tactics. I will be thinking of you and sending you very positive vibes for tomorrow. I have been following your updates and with all you have said in the past couple of days I am feeling much more positive for your outcome. Like the pp said, if for some reason the judge does not order that your daughter is immediately returned I would wait for ex to drop him at his mothers and go get her, the police will assist you with this if she refuses.

Does anyone have an opinion as to whether the judge will proceed and rule that my ex return the baby as recommended by the GAL in the absence of his lawyer
Keeping in mind that this is only a pretrial and usually they don't hear alot out of the parties but yet that a letter has already been submitted by the GAL and my lawyer has already filed motion for emergency temporary custody.
Would the judge hear the motion without his lawyer, typically.

Also thank you all for your thoughts and prayers. This time tomorrow I will know what's going to happen. Continue to pray.

Is his lawyer aware of the motion for emergency custody? If she is then not showing up seems to be irresponsible. What does your lawyer say?

She absolutely knows. My lawyer sent a copy to her, to the GAL, and of course to the courts.

I talk to him again today but at this point my lawyer is saying that he is 90% sure that I will have my baby back in my care tomorrow at some point.

But I think he was more hopeful before finding out she wasn't going to show.

One last request for prayer. Tomorrow is a big day.

I just pray that the judge listens to the GAL and my attorney. Since it is just a docket call they don't always entertain any evidence but my GAL and attorney are convinced they will given the special circumstances.

good luck, My ex took my dd for 3 days, filed with the courts, and got to keep her for a year and a half until we went to trial and I proved he had abused her to the judge. Even then, they wanted to give her a gradual transition, which was nice in theory, but ex wasn't playing nice and I had to go back to court multiple times until I finally had the order enforced. Keep asking for advice because if you deal with an ex who doesn't follow his agreements you will need to be very careful.

Also why are you waiting for a protective order? If you are afraid of him, you should have a temporary one in place until they rule on a permanent one. Do you even need an attorney to ask for one? In my state an attorney isn't necessary to ask for one.
