Unfair breast-feeding in South Dakota

Hello all. I am thoroughly ticked off right now. There was an incident yesterday in Sioux Falls, SD. A woman who was sitting pool-side at a fitness club, which is linked to one of the 2 hospitals in town, was asked to leave the pool area and nurse her 2 week old in the locker room. This mom was watching her 3 older children in the pool and was nursing discreetly-who cares- through a nursing shirt. She asked to see the director and was told that it is the policy at the wellness center to allow breast-feeding only in specific areas. She was told they would have a meeting with the board about 'letting' her nurse only if she used a cover-up! I then let this story slip to an online mothers group sponsored by the local paper. The Wellness center posted that this woman was exposing herself to young children and they will keep their policy in place. I am running low on patience with the hostile environment here and want to know what to do. We currently have no LLL because we do not have a leader here. this is the biggest city in SD! I am a birth doula and help run a birth network and lately the climate is getting much much worse. I recently heard from a client that a lactation consultant, through the hospital, slipped a can of formula into her diaper bag during a consult!!! The mother, a NICU nurse asked what she was doing and the consultant told her it was in case nursing didn't work out. What should I do? I can't take this lying down and I am naive as to how I should get help with this. I personally want to fry the butt heads at the wellness center and I have talked to the director of the hospital who has called in risk management. I want to proceed and make some changes here, but I want some experienced voices to shed some light on this for me. Let the advice begin ladies, I need it!!

I have no answers. This all makes me terribly sad. I have a hard time seeing how it is we're so "progressive" when this country can't even give/show support to the ones who are raising the next generations.

Oh man, that is a rotten situation.

There is probably not much you can do legally -- since this is a private club. But I would definitely be writing members to the board of directors and raising a big stink in the media if they are not responsive. I am sure there are others here who have more specific ideas.

Here is the Law in SD:

South Dakota simply exempts breastfeeding in public from their indecent exposure statutes. This bill was passed in 2002.

Law §22-22-24.1, 2002
2002 S.D. ALS 109; 2002 S.D. Laws 109; 2002 S.D. CH 109; 2002 S.D. SB 184; S.D. Cod.
S.D. Cod. Law §22-22-24 states in pertinent part:

(7) "Harmful to minor"....

(c)Taken as a whole, is without serious literary, artistic, political, or scientific value for minors. This term does not include a mother's breast-feeding of her baby; ...

(9) "Nudity," the showing or the simulated ...

... opaque covering of any portion thereof below the top of the nipple; or the depiction of covered male genitals in a discernibly turgid state for the purpose of creating sexual excitement. This term does not include a mother's breast-feeding of her baby irrespective of whether or not the nipple is covered during or incidental to feeding;

(10) "Obscene," the status of material which:

(a) The average person, applying contemporary community standards, would find, taken as a whole, appeals to the prurient ...

(b) describes, in a patently offensive way, prohibited sexual acts; and

(c) Taken as a whole, lacks serious literary, artistic, political, or scientific value. This term does not include a mother's breast-feeding of her baby; ...

(14) sexual battery or simulates that sexual battery is being or will be committed. The term includes encouraging, aiding, abetting or enticing any person to commit any such acts as provided in this subdivision. The term does not include a mother's breast-feeding of her baby;

Did you contact www.firstright.org about this? They may be able to make a few phone calls about this. It's always nice to have a professional handle these difficult situations especially since they have no emotional involvement with the incident. Good Luck!

That makes me really sad. I used to live in Sioux Falls, and now I can add one more reason why I'm glad I don't anymore.
I live over on the other side of the state now. There's no LLL here either; what is up with that? Aberdeen has one, or at least used to. Our local lactation consultant is AWESOME though and would never pull a formula stunt like that! That makes me the maddest-someone who ought to KNOW BETTER.
I've been NIP all over the place the last month or so with no problems. Oh I really hope it stays that way.
