Hep B without permission

is there legal means against the hospital/doctor/nurse? I would think so. I'm not asking for myself but someone else..What do you think?

I would think so too, because at regular appointments at the doc's office you need to sign a paper accepting [absolving anyone else of responsibility in case of injury] the vaccines, don't see why a hospital should be any different.

If it was done at the hospital, the parents might have signed one of those blanket consent forms. Hospitals have one that basically says "You have permission to treat so and so" If they signed one of those, the hospital is covered.

So they can shoot up a newborn with anything they want and you can't do anything about it unless they have a serious reaction or death b/c of it?? That seems SO very wrong! What happen to patient rights?

I can only speak for the hospital I go to but I asked DH to go with DD any time they'd take her to the nursery to make sure she wasn't accidentally vaccinated. The nurse who was standing there said "You're very welcome in the nursery but just to put your mind at ease we HAVE to have the signed hepB consent form sitting next to the baby before we are allowed to administer the vaccination."

I mean, DH still went but I was glad that she accepted the fact that they need MY permission. For us there was a separate sheet that specifically asked about the Hep B vax. I had to put a big X on the page and wrote REFUSED on it.

If I were your friend I would get to the bottom of it. Tell them to remember that the squeaky wheel gets the grease.

I wonder if this goes by state? Here in CT, Heb B is a birth mandate and they didn't need a separate form...I actually had to sign a refusal form. The only thing that was not covered here was the radioactive dye they wanted to use to do the kidney reflux test.

whoever did the injecting would probably be subject to a reprimand of some sort. But yeah, no way you're going to win a lawsuit or anything.

Same here but....when I went to check on my dd at the nursery, there was a vial of hepb in her bassinet, ready to go....despite the "do not vaccinate" signs I put up on her bassinet and despite the fact that I told them and, iirc, wrote up a little statement indicating no vax.

Be very vigilant and careful! The nurses are on autopilot!

I know when my twins were born, they handed me a piece of paper and said "sign this" I asked what it was for and she said it gives them permission for the hep B vax, side effects, etc. I refused of course but I figured this was pretty standard practice. I mean, this is YOUR baby, that is a foreign agent that you are injecting into them and they can just do it without your knowledge or consent?? That just seems : to me....Poor baby

We signed the form that said we were refusing the HepB vax... when we got home from the hospital I was going through all of the paperwork and noticed a yellow vax card- and it was stamped stating that DS in fact was vaccinated. I honestly have no idea if he really was or not- Of course I was fuming, but decided since DS seemed to be fine it wasn't worth pursuing- But I am still upset that I don't believe our parental decisions were respected. It is frustrating.

I asked my son's pediatrician that I've been vaccinated for hep B and my newborn promises not to have unprotected sex or share needles so why do you want to vax him? He really didn't have an answer for me. I hate the thought of vaccinating a brand new newborn, especially with one of the least important vaccines.

I really think that many docs and nurses think that we are crazy no to want to vax our kids, and that they are doing what's best for our children, and that's how some kids get "accidentally" vaxed...

Ohhhhhh I would be soooo mad!!! So glad you went in there. That is one many fears of mine of giving birth in a hospital.

I had my second baby at a military hospital in CA.I had spoken to my Dr about refusing the Hep B,signed the refusal form,put it in my birth plan,spoke about it again when I was admitted,signed another form and when my son was born the nurse said "oops!Oh well...":Since non of my other complaints about that hospital had ever even been acknowledged I gave up.They just get too caught up in SOP.
My third birth even though I had gone through the whole process they still asked me.I learned not to trust them and had my mom watch over DD like a hawk.She did have to shoo them away too.
