Actually, it won't be accurate until 24 hours after your milk comes in (the baby has to be digesting milk for 24 hours). When all these state laws were written, they put it at 24 hours after birth, never dreaming that some people might actually breastfeed instead of formula feeding from birth. :

We were discharged 8 hours after I transferred last time. But I knew the backup OB, she wasn't just meeting me for the first time. She was very nice and she called the Ped and had him come to discharge the baby. Otherwise I dont know if I would have been given any resistance.

If she has hospital privileges, she can discharge you both (at least here they can). I left hospital 3.5 hours after birth with dd1.

I guess it all depends on where you live. I know at the hospital I work at it, would most definitely get a CPS referral. (I'm not sure where it would go from there...probably no where) FYI we have to do CPS referral for all sorts of things (positive drug tests or admitted drug use, no prenatal care....) 9 times out of 10 the person gets a visit from the Social worker in the hospital to assess the situation and that's it. I'm not saying I personally agree with all this, but just saying how it's done here.

Some places will discharge earlier. I guess to limit the drama, I would talk to the OB ahead of time and the Pedi ahead of time. Not so much to get their "permission" to be discharged earlier, but to explain what you want. Chances are if they are "in" on it, they can just go ahead and write the order for discharge and there will be no issues.

The hospital can call CPS all they like, but without a warrant CPS can't set one foot inside your home (though they'll do anything they can to convince you otherwise).

I left (with DD) about 18 hours after birth. Some in the hospital were supportive of it and willing to let me go even earlier, but there was this one awful nurse who kept putting up roadblocks (like "forgetting" to tell my OB that I wanted to leave, and it fact telling him that I wanted to stay another night). I didn't have to leave AMA, but I did have to threaten to leave AMA if they didn't get everything done they needed to get done in an hour. Anyhow, I gave birth at around 10:30 PM and checked out the next day around 4PM. With my DS2, we left in a little over 24 hours (He was born around 6:30 AM and we left around 10AM the next day). They would have let me go sooner, but not DS as he was preterm. He wasn't having any difficuties, but because he was early they were insistent on keeping him at least 24 hours to make sure he was nursing well, keeping his temps up, and not having breathing issues, which I don't think was unreasonable - he also had to do the carseat test (sit in his carseat for an hour while having his O2 levels monitored to make sure he could breathe well eough to be in that position for the ride home) due to his gestational age. They were really good about getting us out as soon as possible, though, especially because they knew I had been planning a birth center birth had he been full term.

As for tests...

My four children were born at home. I never did any of those newborn tests for my younger two children. They are now 16 and 23 years old.

Just because your kids were ok does not mean all kids will be as lucky when it comes to the disorders the newborn heel stick tests for. There are mamas here at MDC whose children were diagnosed with metabolic disorders before they were able to do damage because of the heel stick.

At my birthing center and at the hospital my Ob works at he will discharge the mothers when they feel fit if there is no problems. The Pediatricians release the babies aswell as long as nothing is wrong. They usually want you to come back and do the tests at the correct times, they give you a sheet to remind you. I stayed for 2 days, and actually enjoyed my little vacation. I thought I was going to want to leave earlier and discussed it with my Ob and Ped before hand, but changed my mind after I delivered. Was comfy there.
