Help dads!!

Hello,

I hate to crash your forum & I promise I didn't read any other threads but I'm hoping you can help me out. I've tried google & I'm not getting anywhere. I thought you guys might have already gone through this.

I'm going to be a new mom expecting our first baby in about a month.

My DP works for a contractor in a specialty trade. He used to work for himself but when we found out we were expecting he wanted a more steady paycheck so decided to go work for someone else. He has been there about 6-7 months now.

His boss told him yesterday he can't have any time off when the baby is born. He didn't want a lot of time, just like the first 2-3 days or so, depending on how it fell with weekends and such. His boss said if he takes a few days he may as well just not come back. DP didn't seem to care much, he said he is going to take as much time off as he wants and if they fire him he will just go back to working for himself. He doesn't like the job that much anyways.

I would really like to see him keep the job for a little longer... its nice to have 2 steady paychecks. At least for another 6 months or so untill spring comes and working for himself would be more profitable. We can live comfortably on either one of our jobs, but I was hoping to work shorter hours this winter and I wouldn't feel right doing that if I was the only paycheck we have.

I guess my question is - Can they fire him for taking a few days off with a new baby? The company is too small for FMLA and he hasen't been there for 12 months to qualify anyway. We live in NYS. Any thoughts or suggestions would be really helpful.

Wow, sorry about that situation. I don't know much about the legality of your situation, though. My work doesn't give any paid leave for me, but I was allowed to take as many available vacation days as I needed (I took 5). In the US, this stuff sucks for Dads.

Sounds like your DH's boss is a jerk.

I found this website, which lists family leave laws by state. It appears that New York doesn't currently require anything, which is sad.

I also found a website (http://www.timetocareny.org/) which is trying to get NY to pass a family leave law. So sign up if you live in NY!
