Kicked out of daycare -Santa Fe, NM

I got a frantic call from my 19 year old sister in NM that her child
cannot attend daycare unless she shows proof of immunization by
tomorrow and that objection forms will not be accepted. Her child is
1 and has never been vaccinated. She has an exemption form (philio)
which is provided by the DOH in NM.

I told her to make an appointment with the director, bring in a copy
of the statute and her exemption form. This daycare is run by the
local community college. I told her to calmly tell the director that
she will not be providing a copy of her child's shot records and hand
her the exemption form. If the director says that she cannot take
it, advise her that because her daycare takes state funds (which is
how my sister pays), she has to abide by the NM statutes that protect
a parents right to object to the vaccines.

I asked my mother to go with her so that she has support.

Can anyone suggest anything else? Does anyone know people in NM that
could go with her or help her (groups/advocates)? She is afraid that she cannot attend class.

That is what she submitted and they are telling her they will not accept any exemption. I don't see how that is possible since the daycare receives state funds???

I think it depends on the state. I'd think that the fact that it should be considered a "public" school because it's attached to a public college might be more imporant. Especially if she mentions religous descrimination.

If they take state funds, they have to accept state approved exemptions.

Just ask. If they participate in a food program or allow parents to pay with subsidized care, then they take state funds.

i would ask these questions before submitting what you have found though... Than way ball is already in your court...

Since she's in Santa Fe, she could always try to mobilize the entire staff of Mothering magazine to march down there with her and read them the riot act.
Seems like it might help if she also told the director that she would be alerting the local media to the fact that the center is in violation of the state statutes.

Great offer. She did what I told her and it worked. It was a misinformed employee. They accepted the form with the statute attached. I think I may have jumped the gun, but it freaked me out that they did this to her. She is at a very vulnerable age and I think could easily be swayed by the masses. I hate to think of those mothers that believed that load of crap and took their babies in to be overly dosed People in NM are fortunate to have a philio exemption--its too bad that more people don't know about it.
