Can they call CPS?

A friend has a doctor that told her if her kid didn't get the chicken pox and MMR shots by one year old, she was calling CPS. Is that legal?
I thought I read in here once that vax status isn't a CPS issue?
I can't find that info right now. Does anyone know where I could find this info?
Also, anyone in Naples FL with a good doc?

Why doesn't your friend just switch Dr.s?

I wouldn't be seeing that Dr at all anymore!

As far as calling CPS... I am sure they could... but they have no grounds to do anything, your friend has not done anything illegal by turning down vaccinations. She has every right to make that decision for her child... period.

I know I have read more about this issue here, but I don't know the in and outs well enough to give you direct information.

Look up vaccination in your state, and see what is required. Tell your friend to go get a religious exemption or philisophical if it exists in that state. You could suggest that she remove her child from any vaccination registry lists as well.

I believe her dr. was using a scare tactic, perhaps a notorized letter from a lawyer stating her rights being sent in response to that scare tactic would be a good idea!

our old ped called CPS on us for not getting the cp vax....the health department sent me a form to fill out about vaccination history which I threw out. its not a legal issue. its an ego issue.

Of course keep in mind that they have absolutely no rights to tell you what your religious beliefs are... you do NOT have to be affiliated in anyway with a religious organization.

Anyone can call CPS, for any reason. CPS then decides if a situation is worth investigating, and then if it is worth investigating...if the children are in danger.

So, sure it's possible the doc could call CPS. But vaccinations aren't a legal mandate, so it's not an issue that should end up being a CPS battle.

However, a doc that threatens a patient in such a manner? Find another one.

Our first pediatrician had a similar arrogance. She told me on their two month checkup that today the twins WILL (her emphasis) get x vaccine adn they WILL get y vaccine, etc. I felt she was trying to bully and/or intimidate me and trying to make me think I had no choice. I was physically SHAKING when I left. But I did not vaccinate that day. And I did find another pediatrician. I will not tolerate that type of bullying or arrogance from a doctor. How could anyone even think of staying with a dr. like that?

BY one year old?? I thought a lot of docs don't even give it til 15 months. I know my doc doesn't even offer it until the one-year checkup. Sounds like a scare tactic to me.

Anybody can call CPS for ANYTHING. Doesn't mean CPS could/would do anything. Honestly though, as others have said, if any doc ever threatened me about ANYTHING, I'd walk out. Period.

I wonder if you could report the dr to the state liscensing board and the AMA, at the very least, there's often a place to comment on your dr's care. It's harassment and should be reported to somebody. Anybody used this site? http://vaccineinfo.net/harassment/index.shtml

Any doctor who threatened me with such nonsense would be reported to the state medical board, the AMA, and whoever else I could think of. I might also have a lawyer send them a scary letter asserting my right not to vaccinate my child and assuring them that if a call was made to CPS, legal action could and would be taken for harassment, intimidation, and whatever else my attorney could come up with.

That is absolutely unacceptable. It goes without saying that your friend should find another doctor, but I wouldn't hesitate to go even further and try to get them sanctioned as well. There is NO excuse for such bullying. None.

You might want to add your experience of that doctor to ratemds.com to warn others. I'd avoid ANY doctor that would threaten to have CPS investigate because you don't bow down to their demands.

CPS couldn't and wouldn't investigate this. It's not even something they can enforce.

Thank you for the replies. I passed on what you ladies said to her. I hope that she decides to change doctors. The thought of having CPS called for not vaxing your own baby is really terrifying.
