Bills move forward in VA and UT

Dear Friends,

Bills that would make CPMs legal made great strides forward in VA and UT recently! The Virginia bill licensed CPMs, while the Utah bill is voluntary regulation (regulation would allow carrying meds).

VIRGINIA
On February 10 a Virginia bill to license CPMs was successfully voted out of Committee and passed in the House 91 yes to only 9 no’s! The bill is now in the process of going into the Senate, with various negotiations to “fine tune” the bill so that it is most likely to pass without compromising on essential issues. The Senate Education and Health Committee is going to look at the bill on Thursday, February 26, and could either vote on it or send it to a Subcomittee on Health Professions for a hearing. This has been a long time coming! Good work Virginia midwives and activists!!

UTAH
The Utah bill, which has been in the works for several years, calls for a voluntary, autonomous, an advisory board made up of four midwives and one member of the public, able to carry meds if we certify (that we get on our own recognizance) and have the statutory ability to deliver babies in "any out-of-hospital" setting. On February 18 the bill passed the Utah House 46 to 28, with support from “unexpected quarters” according to Holly Richardson and Suzanne Smith.


The different bills reflect the differences in the states – history, culture, power of the medical board, etc. A lot of people have worked hard for a long time, and results happened suddenly. Of course, in both cases, this is just the beginning steps of the legislative process, but they are very significant votes and very positive for the next steps.

Unfortunately HB227 Midwife Certification Act was defeated this morning in the Senate Commitee hearing. I was really hoping that we would be able to make it through. Our Attorney General made a statement 3 weeks ago that if the bill did not pass he already has a list of midwives that will receive cease and desist letters. It is illegal for midwives to administer pre-post natal care, labor support, monitoring of mother and baby during labor and catching the placenta. They only part of birth they can legally assist in is the actual catching of the baby.

We will be able to reintroduce the bill in next years legislative session. I pray that it will go through then.
