Please !!! take the time to send an e-mail asking your Senator to vote AGAINST this bill. It puts a $250,000 cap on any damages a drug company will have to pay in a medical malpractive lawsuit. It also makes is almost impossible to prove guilt on the part of Big Pharma.
"the bill has language that allows punitive damages only in the narrowest of circumstances: when someone maliciously intends to harm a patient or fails to stop harm when they know it will occur.
Additionally, drug companies must lie or withhold "material" information from the FDA or bribe an FDA official to be held liable for punitive damages.
"No one is ever, ever, ever going to get punitive damages" under the measure, said Carl of the Association of Trial Lawyers. "That is a criminal (law) standard. It will never happen." "
The drug companies are complaining about how much money they've lost in lawsuits (brought by families of people who've DIED). Wonder how much money they've spent getting this bill through Congress?http://www.denverpost.com/nationworld/ci_2890279
