I have not posted much.


But, IMHO:


1) You need to go back to Court and seek the ability to make decisions regarding schooling for your child.  You will need to have your Son's Pediatrician come in, you will need his medical records, and it might get a bit expensive...but your only other alternative is to turn your X into Children's Services for failing to meet the Child's medical needs and educational needs.


2) You need to fight everything.  I know it probably wont help for this school year, but in all honesty, how is it not going to hurt him to miss 2 class periods of school a day.  The subjects in those two periods are not going to be learned...and therefore it has the potential for having an impact on his learning.


3) Yes, you need to find an attorney in your state, not necessarily in the area where you live, that specializes in Special Education/Education law.  I do believe the wrightslaw website has a list of attorney's in various states who are in that practice.


Good luck.  Last year, in order to get my child placed in Kinder to meet a deadline so we could qualify for Ed Choice Voucher, I had to threaten to pull him out of his special education services for the remainder of the year (last quarter).  Because he was "special needs" they said they could not "register him" until all the other kids were registered and then they had to see what services were going to be available at what school (ie based upon returning kids with needs).  You may have to go up to the State's Department of Education.

I definitely need a specialist lawyer!  I spoke with my divorce lawyer and she told me it would be a waste of time to fight ex in court with only 18mos of minority to go bc it would take half of that time just to get through mediation and be put on the docket.  Plus, I have been trying really hard to keep the proverbial peace with him so I figured if I had to bitch out on someone, the school was the better choice.  So much for the high road!  LOL
