HR is checking into this, and I can't say it would be the worst thing that ever happened for me to hop back into the OBs office once more before/after birth, but I went down to talk about my FMLA paperwork today, and the HR person in charge said I have to have a doctor sign off. I'm assuming this means I also have to have a doctor check me back in. :

I'm having a HB with a CNM, so this obviously creates certain issues. Mostly just that I'm annoyed that I'll have to see an OB twice for pretty much no reason other than that a CNM isn't smart enough to release me back to work.

Anyone have experience with this? How did it play out?

Did you ask the HR person if the midwife's signature would be acceptable? Some people use "doctor" in sort of a generic way.

I asked...it was clear she'd never been asked this before. Her initial impression was that it would have to be an actual doctor, but she said she'd check and see if a midwife's signature would do.

My midwife signed for me too. I never saw a doctor at all.

I bet she was just using that as a generic term.

I would try to tell HR that you are under the care of a midwife and they will sign your paperwork. You are not under the care of an MD. I'd ask for forgiveness, rather than permission.

My mw signed mine. This is a situation where I do not ask permission, I would just assume OF COURSE it is reasonable for a mw to sign it! (But I guess it is a little late for you since you already 'fessed up!)

The HR person probably doesn't know. I also had my midwife sign mine. If you go on the FMLA website, it uses the language "health care provider." Just have your midwife sign it, and let the HR person deal. She's probably just heard the term "doctor" and assumes that ONLY doctors can sign it.

At my company it states doctor, OR CPN or CNM for pregnancy related leaves. I wouldn't think it would be a problem since you are under her care. I might mention to the HR rep that they should look at getting the language changed for the future.

Ha ha ha I'm in Legal so I should for sure have them change the language if necessary. Thanks for the backup ladies.

My midwife signed mine. Check the paperwork. My paperwork says "physician or practitioner."

I am in IL and my midwife's sig was sufficient. TBH, I never even asked about it - didn't occur to me. The midwife was my medical provider, so that was that.

My MW signed mine for me too. I think it has to me a licensed medical provider so you might have an issue if if MWs aren't licensed in your state or if you use a lay MW.
