If you had your own business (sole proprietor) , and came up with a name that was in use with a similar business across the country, would you hesitate to use it? i know typically it only matters within your own state, and the type of business that it is, unless it is a big company that has special rights to their name. I'm talking about small-time, local clientele only. While I know legally that it's fine, I still feel like I'm invading someone's territory a little (same profession, similar web domains, etc) Maybe because of websites and fb and all that- However, I know it happens all the time. For example, in my town there will be a childcare center named one thing, and across state line there is another with the same name/different owners.
Just trying to sort this out, would love some thoughts on the matter :)
I think I"d be o.k. using it if it was a business in another state.
