NYS liscensed MWs: Is this true? - Mothering Forums

I was discussing with my midwife how I would really like to have a home birth.. but being a solid hour away from a hospital has prevented me in the past.. and this time too. (due in Dec.).
Midwife said that in NYS it is illegal for a liscensed midwife to perform a homebirth and her liscence would bew taken away,, and if anything were to happen to baby during a homebirth mother would be charged with child abuse.. endangering the welfare.. or something like that.. Is this true..are there no homebirths in NYS???

I don't know about NY. But I know for sure that is the law here in DE and it really stinks.

I believe that in 2001 NY began allowing homebirth, Im not sure, they seem to go back and forth,
I DO know there are homebirths there...I know moms in NYC who have had babies at home,

i know a woman in nyc who gave birth to all her children at home (she's got around 10 kids), her oldest is 23...so i'm not sure about a law like that.

I've had 2 homebirths, both legal, in NY. So, I am not sure what law this is that she is talking about.

I had a legal homebirth in New York City with a CNM. I know that it is more difficult in the rest of the state, but I am still confused as to why. I know lay midwives are not considered legal, and I believe there are issues with CNMs and insurance and backup doctors, but that's all I know. Try calling the Birth and Life Center (I *think* that's the name) in Albany. Maybe they could tell you about someone.
